What is mediation and do I need it?

The simple truth is that some people will need a bit of extra help communicating with the other person after separation and divorce.

Mediation is a process of helping you both talk with a view to resolving your differences out of court.

An independent mediator, who doesn't take sides, helps you have an effective and meaningful conversation so you can solve the problems you are facing. The mediator will help remove the cycle of blame and shame and will focus on the future so you can both move forward in life.

Mediation is incredibly successful at resolving family law disputes, in fact a study run a few years ago in South Australia suggests that mediation assisted almost 80% of conflicted couples resolve their disputes outside of court.

Mediation can be any length of time really, but in my experience it takes at least 2 - 4 hours to really get to the heart of the issues and negotiate a mutually agreeable way forward. 

Some will take more and some will take less, it will depend on how many problems we have to solve!

At The Separation Place we only offer mediation online so we can provide our services to people right across Australia.

We have a streamlined process where you can book, pay for and log into and participate in the mediation from anywhere in the world. 

When you book a mediation you automatically receive free access to our online programs. For example, if you book a parenting mediation you will have access to Family Matters free of charge.

In this brave new world of ours there have been some positive changes to the way we use technology to make our lives easier. Family mediation is no exception.

After booking your mediation you will be sent all the information you need in an email including links to book and complete the paperwork online. We have streamlined the process to make it straight forward and fuss free.

During the mediation Rachael will facilitate the conversation, help you come up with some options and solutions and draft either a parenting plan or heads of financial agreement for you.

That is completely up to you.

If you are able to be on the same screen it can sometimes speed up the process. However, some feel that they just can't negotiate or communicate effectively if they are confronted by the other person, even on a screen.

If one or both of you elect not to see one another, you will be placed in separate (virtual) rooms and Rachael will move between the two rooms facilitating the discussion and negotiation.

Rachael Hempling is currently conducting all mediations for The Separation Place.

Rachael is a nationally accredited mediator and family dispute resolution practitioner registered by the Australian Department of Attorney General. She has over 16 years experience as a lawyer and now practices exclusively in family mediation.

She has kept hundreds of people out of court with her work as a mediator.

A 2 hour mediation* costs $450 per person (or $900 in total).

A 4 hour mediation costs $900 per person (or $1800 in total).

* Please note that in a 2 hour mediation we may not have sufficient time to draft a Parenting Plan or a Heads of Financial Agreement. If this is important to you, then you should book a 4 hour mediation.

To be honest, you can't make them come. People need to attend mediation of their own free will and be willing to make a genuine effort to resolve the issues.

However, we do offer a service where we get in contact with the other person and invite them to mediation and highlight why it would be a good idea to attend. This service costs $397 and includes a section 60I Certificate if they refuse to be involved. A section 60I Certificate is required (in most cases) in parenting matters before you make an application to court.

In short, no.

To make it binding you will need to make an application to court (by consent) or consider a Binding Financial Agreement to make your parenting and/or property agreement binding. Your lawyer can help you do this.

No, we don't draft orders or Binding Financial Agreements as we need to remain completely independent and neutral through the entire process.

We always recommend you go back to the lawyer who referred you to The Separation Place. If you think about it, they have already helped you save a lot of money by resolving your conflict out of court using our online tools and services. They have done right by you and are likely to continue doing so.

Yes, but we will always start with parenting matters first and there will be no cross negotiating between the kids and money.

Please also note that 2 hours is not enough time for both kids and money. You will need to book a 4 hour mediation if you wish to discuss both.

How does the process work?

Do you need help getting the other person to mediation? 

The Separation Place offers a full arrangement service whereby Rachael takes care everything for you.

For a fixed fee of $397 Rachael will:

  • Contact the other person;
  • Reassure the other person that she is independent and neutral and doesn't represent either one of you;
  • Reassures the other person how mediation is a positive and empowering process to resolve your differences;
  • Explains the process in full;
  • Answers any questions;
  • Liaises with you both to find a mutually agreeable time and date; and
  • Provides a s 60 I certificate if one is deemed appropriate and/or necessary.

Which package do I need?

Up to 2 hours

This short form mediation is only suitable for a parenting or property mediation, but not both. It's an appropriate option if you are nearly there but just need a little help with one or two issues. It's probably not appropriate if you have little to no agreement before you start. You'll need more than 2 hours if this is the case.

This half day mediation is best place to start for those who need to negotiate a comprehensive Parenting Plan or financial agreement. It is sometimes possible to cover both kids and money, but not always. You can always start here and book a further 2 or 4 hour mediation if you need more time.
